Fox News personality and former Gov. Mike Huckabee (R-AR) recently began appearing in television commercials calling for viewers to dial a 1-800 number to sign a repeal petition against health reform called “Repeal It Now.” The ad, a “project of Restore America’s Voice” (RAV), a political action committee run by Huckabee’s friend Ken Hoagland, also directs viewers to a website that solicits donations [...]


According to disclosures filed with the FEC, RAV’s campaign is managed by a firm called the 949 Media Group. 949 has been paid tens of thousands of dollars to set up RAV’s website and Google search optimization, and receives a regular commission of $10,000 for related media work from RAV. ThinkProgress spoke to a representative from RAV, who told us that 949 is run by an individual named Derek Oberholtzer. According to the representative, Oberholtzer has worked with RAV since the PAC formed in October.


Oberholtzer is well known as scam artist who has used a myriad of tricks to defraud people out of their money. In addition to 949 Media Group, he started a number of companies, including “Apply 2 Save” (A2S) and Giant Media Works. Consumer report websites are rife with complaints about Oberholtzer’s odious business practices. In one scheme, Oberholtzer paid for radio and other advertisements telling distressed homeowners to contact his company A2S to pay a flat $595 fee to receive assistance in renegotiating their loans or to block a bank foreclosure. The Federal Trade Commission has prosecuted Oberholtzer for deceptive practices. In numerous cases, Oberholtzer took the $595 payment, and never did anything to stop a foreclosure or even contact the mortgage company in question. In many instances he continued billing his customers further fees totaling nearly $1,000 without lifting a finger to actually renegotiate their mortgage or halt a foreclosure, as his “Apply 2 Save” company promised.







Oprah Winfrey’s OWN network is set to launch January 1, 2011. After three years of planning, delays and management misfires, it will be the biggest launch of a cable channel in more than a decade.


Here’s what you can expect:


“Oprah Presents Master Class” biography series will share the life stories of those who have inspired Oprah, like Maya Angelou, Sidney Poitier, and Simon Cowell.


“Oprah’s Next Chapter” features the talk show host interviewing, but this time it will be outside of a studio! She plans to visit “interesting places — in front of the Pyramids, the Great Wall, or in a village in Kenya.”


“The Gayle King Show” brings Oprah’s best friend’s radio talk show to TV.


“Your Own Show: Oprah’s Search for the Next TV Star” features Oprah looking for the next big thing with the help of “Entertainment Tonight’s” Nancy O’Dell.


While the network’s shows sounds promising, viewers finding the channel poses a problem. Winfrey’s network will mostly reside on channels above 200, taking over the position of the Discovery Health Channel. According to The Canadian Press, comScore, the marketing intelligence service says Canadians are leading the way in hours spent online.


Canucks are spending an average of 2,500 minutes online per month which translates to over 41 hours, that’s an entire full-time work week spent surfing. And that’s apparently more than any other country in the world. Based on this data, it seems that Canadians are rapidly adopting the digital lifestyle and seem to be wildly passionate about online video, social media and Wikipedia.


If you take a look at how many Canadians are visiting YouTube, per capita, the great white north is smoking the rest of the world with 21 million Canadians visiting every month. That might not seem like a lot but considering the size of Canada’s population (34,238,000) that’s a lot of YouTubing.  YouTube is obviously deeply embedded in Canadian culture and it’s clear by the data.  Not only are Canadians hitting YouTube more (per capita), they’re also viewing an average of 147 videos each month: that’s 47 more than American users.


In the last month, Canada was ranked #10 on Socialbaker’s Facebook user list. It’s reported that Facebook has penetrated 51% of the Canadian population with 17,288,620 users.  When you view the penetration rates of the top 10 countries, Canada once again takes first place.  Americans came second in the top 10 contenders coming in a 46.98% penetration of the population.


While the exact number of Twitter users by country isn’t available yet, we know that Twitter has been gaining momentum in Canada throughout 2010. Twitter stated  “What we can share is that the number of Twitter accounts in Canada has increased by 75 per cent since the beginning of the year, and the number of daily tweets more than doubled..” And, we’re also seeing Canadians are using the user generated site Wikipedia more than any other country.  This data is based on 16 Wikipedia page views per month on average coupled with 217,000 Wikipedia edits a month.


The Canadian Press article highlights the fact that back in April of this year, comScore estimated that 68% of the Canadian population is online. The proof is in the pudding folks, Canadians are a group of highly progressive and tech savvy people.  Canucks might not get the hottest gadgets on release date but they’re poised to drive their gadgets online more than anyone else.  What do you think is the cause of this obsessive online behaviour.. TRON Guy on open source, DIY ethos, & plans for a suit sequel


Andrea James is a writer, producer, filmmaker, and activist for consumer issues (including hair removal & transsexual transition) plus LGBT film & families. She's a long-time Wikipedian and recommends noteworthy films & books.






Jay Maynard, aka TRON Guy, was kind enough to do an interview in honor of this weekend's #1 film, TRON: Legacy. He's seen the film again since his Wired review, and I asked him about his favorite surprises that were a nod to the original (hearing Journey's "Separate Ways" at high volume). He also liked a lot of the repurposed lines, but he didn't want to drop any spoilers. He wanted to see MOAR of the fastest thing on the grid: Sam with Flynn's lightcycle. Outside of his TRON fame, Jay is project manager on the open source Hercules project, so we talked a bit about the film's take on open source and cracking, etc. Jay also has some excellent advice for makers and cosplayers alike after the break.


How many personal appearances have you originally made since your original suit?



A few dozen, mostly right after it was first sprung on an unsuspecting world, muah ha ha ha. I make a few a year now.



What has been the highlight of your experiences since putting up your site and photos?



Appearing regularly on Jimmy Kimmel Live! was definitely the highlight. I had a lot of fun doing that show, and they went out of their way to make me feel like I was special and yet part of the family. If they asked me back, I'd go in a heartbeat.



Any plans to make a new suit based on the sequel?



Very definitely. I've got a pretty good idea of how I'd approach it. The main things I need now are time and money; the rest I can acquire.



Do you play video games, and if so, do you plan to check out the TRON: Evolution game? As you may know, it covers the time period between the original and the sequel.



I'm not a gamer, but I am planning to get TRON: Evolution. I also expect it to mop the floor with me. The big question for me is which version to get, especially since I'm a Mac person who refuses to run Windows and don't own any of the consoles it runs on.



What is your opinion on how hackers and open source are presented in the new film?



I truly believe in open source. I'm rather ambivalent about the portrayal of open source in the film. As Sam Flynn's cause celebre, it provides his motivation for being involved with Encom at all; at the same time, it takes a very Stallmanite view of open source that, I think, does the whole arena a disservice. Not everyone in the world of open source agrees with Richard Stallman's utopia.

As for hackers, the movie shows Sam as a cracker, not a hacker. I refuse to honor those who break into computer systems and steal things with the term "hacker". On the other hand, if Sam's only stealing from himself...



Do you have any tips for making a suit like yours last longer, or any design changes you would make now?



My costume is getting close to 7 years old, and it shows it. If I had it to do over again, I'd definitely stiffen the armor where the electroluminescent wire currently flexes, because I've had to splice it a few times, and that stuff is a royal pain to work with. I'd also have silk-screened the unitard so I could do several at once - right now, all I have is the one, and it's wearing badly in spots (mostly invisible).



What is your advice for someone who wants to make something and has never done it before?



Be sure you understand what you're about to do, and wade in. Don't be afraid of making mistakes. If you make a mistake, you're learning things. My hands are full of 40-year-old soldering iron burn scars and such, but I wouldn't trade away a single one of them. Beyond that, measure twice and cut once, and remember that you have it easier than older electronics geeks did: it's a lot easier to change bits in flash than diodes on a circuit board. One other thing: Ignore the naysayers. If you're enjoying yourself, that's what really counts.




For quite a while now everyone and their brother has been lobbing the “when are you going to really monetize Twitter” bombs into the micro-blogging giant’s front yard. It’s a popular thing to do but as of late that cry has lost a little steam (in part due to having real business people like Dick Costolo at the helm) and the latest move by Twitter could put a dent in one of the Internet industry’s favorite pastimes for sure.


The Next Web first reported the new Twitter for Business section and reported


The new version of business.twitter.com will provide business owners with twitter success stores, ideas, tips, tools and resources. Some of the tools included are information on promoted products and tutorials one how to communicate with customers using mobile.


Twitter’s business tools range from basic tips “What is Twitter” to more in-depth information on analytics, case studies, API integration etc.


The main page looks like this and the big attention getter is on the right side, which might as well read “Give Us Your Wallet”



Twitter is no longer just giving advertising a try with a few select folks. Now it’s official that Twitter is really open for business. It’s kind of sad to watch the old “Twitter is cool but hasn’t made a red cent” days go away. Now we have to look at Twitter as a legitimate business. Now whether what they do is meaningful is whole other story.


Along with this new way to get into advertisers pocketbooks, Twitter has updated its Twitter 101 offering with a new presentation of its old material and additional updates.


It appears now that Twitter is moving into the next phase of its development. How well it will work remains to be seen. Does advertising on Twitter give advertisers the best bang for their buck? I’m not sure I understand your hypothesis wrt the MBS tranches. No one who I’ve been reading, about foreclosure, writes about what’s happening to the thousands of houses in foreclosure, except as one-off anecdotes. There was a NYT magazine article about Cleveland last year that indicated there are thousands of vacant, stripped houses that the banks have abandoned, and a pattern of sending foreclosure notices, the people moving out, the house being stripped, and then the bank stops the foreclosure in order to avoid responsibility. But this may just be Cleveland and similar rust belt cities. I’m wondering about the pattern in newer, spiffier towns and neighborhoods, such as the Inland Empire in CA or Cape Coral, FL.


The suspicion that Fannie and Freddie are winding up with these houses is very strong, having just read Mortgage Lenders Meet Resistance in Courts (scroll down) with a graph captioned: “PILING UP: Fannie Mae and Freddie Mac are acquiring foreclosed homes faster than they are selling them, creating a backlog of foreclosed properties that must be sold.”


Getting back to the MBS tranches: If you mean that the foreclosures are to trigger CDSs, ok. But who’s paying off on the CDSs at this point? That news seems to be off the radar now. BAC is suing Old Republic, its mortgage insurer who has now stopped paying.

I actually learned nothing in the Taibbi article that I hadn’t already learned over the past two years of reading about foreclosure fraud (and personal experience). He did an excellent job, as usual, in telling the story of this outrageous fraud, except for one major, major narrative: the intentional servicer fraud, designed to force people into foreclosure, regardless of HAMP. If he wants to really explain why the ‘deadbeat borrower’ narrative is so very wrong he needs to write about the way people who could afford their mortgages are forced out by tacking on outrageous fees. One might even get the idea that the game is to see how quickly the servicers can force people into default, so that the bank can reclaim and re-mortgage the houses. In essence the banks are the house-flippers, taking huge fees, mortgage insurance, and bonuses at each flip.


The case of Ms. Cooper is the norm. The funny thing it points out is the lack of anyone at the foreclosure mills to keep time lines on the cases, in order to make sure the dates on the robo-signed documents conform to a plausible narrative for the foreclosure and how the bank came to have (fictitious) standing. This is more of an indictment of the courts, than just mere sloppiness or carelessness of the foreclosure mills: The fact that it wasn’t deemed worth the bother because the judges wouldn’t notice. Fact: none of the documents exist until foreclosure begins. The documents acquire dates when the robo-signers process and sign them. The depo of Tammie Lou Kapusta explains how it was recognized at one point that the notary stamps were dated differently from the signatures they purported to witness, and that thence forward they had to make the notary dates match the signature date not the date that the notary seal was applied. That’s how sloppy the paperwork was. And it’s those kinds of issues that the banks were trying to clean up in October, during their moratorium.

With profuse apologies to Ernest Hemingway, that butchered metaphor sums up the predicament facing many real estate investors caught in a legal Noman’s land caused by the robo-signing scandal which has left them with properties which they are no longer sure they own.  If they want to get their money back, they may have to prove that the bank knew it was conning them, something that may be difficult to do. They also may face legal action from people evicted from their homes because of faulty paperwork


A foreclosure freeze that several banks instituted hurt sales of existing homes in several hard-hit markets.  Foreclosure auctions have plunged more than 30 percent in California, Nevada and Arizona, according to ForeclosureRadar. Sales of existing homes in Florida tumbled 21 percent in October compared with a year ago.


Though several banks including Bank of America (NYSE: BAC) and housing finance giant Fannie Mae have restarted at least some foreclosures, the process has been irrevocably tainted by the industry’s apparent willingness to put profits above the law.  Their legal exposure  may be gigantic — billions of dollars — particularly if courts find that they improperly evicted people from their residences.  Not only could the foreclosure be reversed, but they could face punitive damages as could the realtors and attorneys involved in the transaction.


But what about the people who bought these homes?  That’s where things get a little dicey.   Clearly, their rights were violated as well.   But in the legal tsunami created by the robo-signed documents, they should be last in the pecking order.  Many of them, particularly sophisticated investors looking for a quick flip, probably knew or should have known that something was amiss.  How is it that the foreclosure process — which is purposely cumbersome to protect the rights of homeowners — suddenly became streamlined?  What about the same people’s names appearing in hundreds of documents?  That did raise any red flags either.


“The ones who are really upset are the investors, who buy on the courthouse steps,” said Kevin Berman, a broker with Bankers Realty Services in Fort Lauderdale, Fla, told CNNMoney. “There used to be sometimes 700 sales a day. Now there are like, seven.”


Adds to this the lower prices that new homes are fetching and it becomes even harder for flippers to make a profit on an existing dwelling that has been extensively fixed up.  It’s human nature to prefer something new over something old if they are priced about the same.


Still, there are thousands of people in this country who believe they have what it takes to become the next Donald Trump.  They get plenty of encouragement from cable television shows such as A&E’s “Flip This House” and Bravo’s “Flipping Out” and TLC’s “The Property Ladder.”   Though these programs do illustrate the downside of flipping — potentially losing boatloads of cash — they make it seem like a grand adventure.  These shows offer as realistic view of real estate as  “Gray’s Anatomy”  does for  medicine.  Untold millions watch the flipping shows, though, and figure that if those bozos on TV can do it, so can I.


This sort of delusional or magical thinking is evidence of what economists call a moral hazard.  Essentially, it means that the government shouldn’t reward people for making stupid decisions.   Though the idea was turned on its head during the recent bailouts of industry, it is still a worthwhile idea.  It shows ` there are consequences to actions.   People who acquired homes that they should have known they couldn’t afford crossed the moral hazard threshold.   They deserve some help, particularly if they can prove they were victims of fraud.   Otherwise, their rights should come secondary to the victims of fraudulent mortgage documents.  Flippers are private businesspeople who should have known the risks they were getting into before they entered a deal.   Few if any deserve government help.


Real estate has become a spectator sport in the U.S., which is unfortunate because many people have business playing it.

I’m not sure I understand your hypothesis wrt the MBS tranches. No one who I’ve been reading, about foreclosure, writes about what’s happening to the thousands of houses in foreclosure, except as one-off anecdotes. There was a NYT magazine article about Cleveland last year that indicated there are thousands of vacant, stripped houses that the banks have abandoned, and a pattern of sending foreclosure notices, the people moving out, the house being stripped, and then the bank stops the foreclosure in order to avoid responsibility. But this may just be Cleveland and similar rust belt cities. I’m wondering about the pattern in newer, spiffier towns and neighborhoods, such as the Inland Empire in CA or Cape Coral, FL.


The suspicion that Fannie and Freddie are winding up with these houses is very strong, having just read Mortgage Lenders Meet Resistance in Courts (scroll down) with a graph captioned: “PILING UP: Fannie Mae and Freddie Mac are acquiring foreclosed homes faster than they are selling them, creating a backlog of foreclosed properties that must be sold.”


Getting back to the MBS tranches: If you mean that the foreclosures are to trigger CDSs, ok. But who’s paying off on the CDSs at this point? That news seems to be off the radar now. BAC is suing Old Republic, its mortgage insurer who has now stopped paying.

I actually learned nothing in the Taibbi article that I hadn’t already learned over the past two years of reading about foreclosure fraud (and personal experience). He did an excellent job, as usual, in telling the story of this outrageous fraud, except for one major, major narrative: the intentional servicer fraud, designed to force people into foreclosure, regardless of HAMP. If he wants to really explain why the ‘deadbeat borrower’ narrative is so very wrong he needs to write about the way people who could afford their mortgages are forced out by tacking on outrageous fees. One might even get the idea that the game is to see how quickly the servicers can force people into default, so that the bank can reclaim and re-mortgage the houses. In essence the banks are the house-flippers, taking huge fees, mortgage insurance, and bonuses at each flip.


The case of Ms. Cooper is the norm. The funny thing it points out is the lack of anyone at the foreclosure mills to keep time lines on the cases, in order to make sure the dates on the robo-signed documents conform to a plausible narrative for the foreclosure and how the bank came to have (fictitious) standing. This is more of an indictment of the courts, than just mere sloppiness or carelessness of the foreclosure mills: The fact that it wasn’t deemed worth the bother because the judges wouldn’t notice. Fact: none of the documents exist until foreclosure begins. The documents acquire dates when the robo-signers process and sign them. The depo of Tammie Lou Kapusta explains how it was recognized at one point that the notary stamps were dated differently from the signatures they purported to witness, and that thence forward they had to make the notary dates match the signature date not the date that the notary seal was applied. That’s how sloppy the paperwork was. And it’s those kinds of issues that the banks were trying to clean up in October, during their moratorium.
